UPDATION OF THESE TERMS OF USAGE
The website has the right to update/amend/modify these terms of service from time to time. To continue to abide by these terms, it is the User’s responsibility to periodically check the Terms of Usage. 

 

USER CONSENT
You (“Member”, “You,” or “Your”) indicate that you understand and expressly consent to the Terms of Usage of this Website by accessing and using it. Please refrain from clicking the “I AGREE” button if you disagree with the Terms of Usage. Before using the website, registering, or accessing any material, information, or services within, the User is advised to carefully read the Terms of Usage. Your use of and continuous use of the Website (irrespective of any changes made from time to time) shall constitute your acceptance of the terms of usage and your consent to be bound by them. 

 

GENERAL DESCRIPTION
The Website is an internet-based that is accessible via the World Wide Web, applications, and other electronic media. It offers astrological content, reports, data, phone, video, and email consultations (hereinafter referred to as “Content”). The website provides “Free Services” and “Paid Services” (all of which are referred to as “Services”). All information that you fill up and submit to the Website, as well as any updates to that information, is referred to as “Registration Data” in these Terms of Usage.
 

You can create an account using the Website ID (Your Phone Number) and password (OTP) or another log – in ID and password, such as a Facebook, Gmail, or any other valid email ID. When creating an account, the User represents and certifies that all of the information given by the User is current, accurate, and complete, and that the User will uphold the accuracy and keep the information updated from time to time. It is specifically prohibited to use another User’s account information to use the services. The Website reserves the right to terminate or suspend the User’s account and restrict or refuse their future use of the Website if it finds out that the information provided on the Website is incorrect, inaccurate, incomplete, or out of date.
 

This Website’s right to use is personal to the User and cannot be transferable to another person or entity. Passwords and other information necessary for registration purposes must be kept confidential, and this falls under the User’s responsibility. The User is completely liable for any activities that occur under the User’s account on the Website. The Website cannot and will not be responsible for any loss or harm resulting from the User’s failure to maintain confidentiality and secrecy. If the User becomes aware of any unauthorized use of their Account(s) or breach of any security, they must notify the Website immediately. Upon finishing a session, the User must log out of their account.
 

When using any service, the User will be informed whether the service is personal to the Website or available from a third party. The Website has no control or monitoring over the information published to third parties via the Website.
 

The User agrees, understands, and confirms that his/her personal data, including without limitation debit card/credit card details, transmitted over the Internet may be vulnerable to misuse, hacking, theft, and/or fraud, and that neither the Website nor the Payment Service Provider(s) have any control over such issues.
 

Any User who meets the following conditions is not permitted to utilize the Services by the Website: 
  

If the User is a resident of a jurisdiction where the usage of the Website’s Services is prohibited.
 

If the User is a resident of any State/Country where entering into trade relations is prohibited by law, regulation, treaty, or administrative act, or/and
 

Because of any religious practices.
 

If the user has used different mobile numbers to create several accounts. The User is only permitted to have one active account with the Website.
 

COMMUNICATION WITH ASTROLOGER
The Website offers a service that is offered through the mode of telecommunication with the Astrologer listed and enrolled with the Website. By consenting to the current Terms of Usage, you are also granting your unequivocal consent to the Website to call you on your mobile number, even if your number is on DND service supplied by your mobile service provider. 

 

WEBSITE CONTENT
The Website and any individual Websites accessible via external hyperlinks with the Website are private property.
 

All interactions on this Website, including direct guidance and advice from the Licensed Provider, must adhere to these Terms of Usage.
 

The User shall not publish or transmit through this Website any material that violates or infringes in any way on the rights of others, or any material that is unlawful, abusive, defamatory, invasive of privacy, vulgar, obscene, profane, or otherwise objectionable, or that encourages conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.
 

The Website reserves the right to suspend or terminate such User’s access or registration, and such User shall not gain access to the Website.
 

The Website keeps up the right to terminate access or change or discontinue any aspect or features of the Website, which includes but not limited to, content, graphics, deals, offers, settings, and so on.
 

Other than the guidance and advice provided directly by the Third-Party Service Provider, the educational graphics, research sources, and other incidental information on the Site, the content should not be considered as medical advice.
 

The Website makes no guarantees on medical advice supplied by third-party service providers, including registered astrologers on the site. For diagnosis and treatment, the User should always consult with a suitably qualified healthcare professional, including information on which medications or treatments may be best for the User. None of the Content indicates or warrants that any specific medication or treatment is appropriate, safe, or effective for you. No particular tests, medication, products, or procedures are recommended by Mauhurtika.
 

The Website makes no guarantees for any undesirable incident that might occur with the User after seeking the Service. The Website or the Service Provider offering the advice is not responsible and does not guarantee any results as expected by the User, and accessing the Website in such a case is entirely at the User’s risk.
 

By using the Site, Application, or Services, User agrees that any legal remedy or liability sought for actions or omissions of other Members, including service providers registered with the Website, or other third parties linked with the Website, shall be limited to a claim against the specific party who may have caused any harm. You agree not to attempt to impose liability on the Website or seek legal remedy in connection with such actions or omissions.
 

USER ACCOUNT ACCESS
The Website shall have access to the User’s account and information in order to provide and maintain the high-quality services provided by the Website and to address the customer’s needs in the most efficient way possible. The user hereby consents to the Website, its employees, agents, and any other appointed person having unconditional access in such regards. The Website will conduct a case-to-case investigation using the records available in order to address any complaints (if any) and any suspected abuse that is reported.  The User is advised to carefully read the terms provided in the Privacy Policy with relation to such records.

 

PRIVACY POLICY
The User hereby consent, expresses, and agrees that he or she has read and fully understands the Website’s Privacy Policy. The User further consents that the terms and contents of such Privacy policy are acceptable to the User, including any update/alteration/change made and duly presented on the Website.

 

BREACH AND TERMINATION
The Website reserves the right to modify, discontinue, change, or modify the ordered services or the Account of a User registered with the Website, in whole or in part, without notifying the User. The Website may or may not give notice or give any explanation for any action taken by the Website.
 

Any violation of any of the conditions listed in these Terms of Usage will result in the immediate cancellation of the User’s Registration, if the User has registered with the Website. The Website keeps up the right to terminate and take urgent action if:
      

The Website is unable to verify and authenticate the Registration data or any other relevant information submitted by the User.
 

The Website considers that the User’s actions may result in legal liability for the Website, other Users, or any service provider linked to the Website.
 

The Website thinks that the User has submitted incorrect and misleading Registration Data, or that there is interference with other Users or the administration of the services, or that the User has violated the Website’s privacy policy.
 

You understand and agree that your relationship with the Website, including the Astrologer, is limited to being a member, and that you act solely on your own behalf and for your own advantage. The Website may terminate and deactivate the Profile of such service provider for any violation of the current terms of usage and the Service Terms and Conditions agreed upon between the parties at the registration of the data by such Service Provider.
 

DELIVERY, CANCELLATION AND REFUND
If an order has reached the “processing” (Assigned to an Astrologer) stage, no refund will be granted under any circumstances.  The risk and liability of making an order in a haste and irresponsible manner is entirely on the User, and the Website is not responsible for any refund once the processing step has begun.
 

Once the Order has been placed and performed, no refund will be issued. However, if the User wishes to cancel a successfully made order prior to execution, the User must contact the customer care team within 1 (one) hour of completing the payment, after which it is entirely at the discretion of the Website whether to offer a refund.
 

Any technical delay or problem reported in the Website during the processing of the request, including report generation by the service provider, i.e. Astrologers will not be eligible for a refund. The User agrees that the timelines are approximate and that all necessary actions will be made to adhere to the timelines as indicated.
 

There will be no refunds made because You submitted incorrect information or data. The User agrees to be cautious while supplying information to the Website and to double-check the input before clicking “Submit.” The User may make a modification to the incorrect information or data entered if the request is made with customer service within 1 (one hour) of the service provider’s execution of the service.
 

Any damaged products returned will not be refunded. The User undertakes and agrees that by ordering any product as displayed on the Website, the Registered User will be fully responsible for any damage caused to the product after its delivery. If an order is placed via the “Cash on Delivery” payment method, the User will be charged for the cost of the product as displayed on the Website and the shipping/custom/courier charges if the product is returned.
 

Refunds on a pro-rata basis may be considered for any delay in the activation of subscription services, and any damage to the product while in transit will be handled by the Website and its agencies. 
 

You agree that the display picture for the products listed for purchase by the User is for reference only, and that the Website will try to deliver the product ordered in the state that it is displayed on the Website. In such cases, the User is advised to exercise discretion, and no refund will be provided.
 

The services provided and product sold are not intended to replace any philosophical, emotional, or medical treatment. The Website takes no responsibility or liability for the realism or reliability of the astrological effects on human physiology caused by the gems represented and sold on the Website. The placing of orders for such products or services is entirely at the discretion and will of the User, and the Website bears no liability for the products sold. In such a circumstance, the User is advised to exercise discretion, and no refund will be granted.
 

There will be no refunds issued for supplying an incorrect contact number in order to use the “Call with Astrologer” feature. Once opting in for this feature, the User is advised to keep the Contact Number in full coverage area and must answer the call when received. There will be no refunds for any calls that are connected.
 

The refunds, if any, will be processed after deducting the transaction charges levied by the Bank and/or the Payment Gateway, the cost of shipping and/or courier charges (in the case of the purchase of a product listed on the Website), customs duty (if levied ), and/or any other charges incurred by the Website while processing and/or delivering the service, as applicable.
 

If the Website or the Payment Gateway’s webpage, which is linked to the Website, is experiencing any server-related issues such as ‘slow down’,”failure,’ or ‘session timeout,’ the User must first check before initiating second payment whether his/her Bank Account has been debited or not and then according resort to one of the following options:
 

If the Bank Account appears to have been debited, make sure you do not make the payment again and promptly contact the Website via customer care to confirm payment.
 

If the User’s Bank Account is not debited, the user may initiate a new transaction to make a payment.
 

However, refunds for multiple payments made against the same purchase, even after taking all of the above precautions, will be made in full, with no deduction for the transaction charges specified above. The Website will only retain the cost of one single order placed by the User.
 

If the Website is unable to accept orders and must cancel them, the Website keeps the right, at its sole discretion, to refuse or cancel any order for any reason. Some situations, such as non-availability of the service, inaccuracy, pricing information error, or other errors as identified, may result in the order being cancelled. If the User’s order is cancelled after charges have been paid for the service, the amount paid for booking will be refunded. 
 

By requesting a refund, the user agrees to grant Mauhurtika’s quality audit team access to the chat/call recording of the consultation for which a refund is requested in order to decide whether the case is qualified for a refund or not.
 

The  Mauhurtika quality audit team provides partial/full refunds to users in their Mauhurtika wallet whenever the consultant’s quality requirements are not met. It may take up to 72 hours for the amount to be analyzed and refunded to the Mauhurtika wallet. 
 

Please keep in mind that all refunds will be credited to the user’s  Mauhurtika wallet. Refunds will be considered only in the following cases:

There was a network issue that caused the chat/call to be interrupted, or there was a weak signal, background noise, an inaudible consultant, and other issues during the video/normal call sessions.
 

Consultant is unable to respond fluently in the language specified in their profile.
 

The consultant is taking an inordinately long time to respond back to the user.
 

The consultant’s response to the user’s enquiry was irrelevant or inappropriate.
 

Please keep in mind that no refunds will be offered if any consultation is not accurate. Mauhurtika is not responsible for the accuracy of any consultations.

 

USER OBLIGATION
The User (including the astrologer and the Member Customer) agrees not to breach the privacy policy, terms and conditions, or any other terms defined on the Website. The User represents that he is a person and not a corporation or other legal business entity. The User owns the rights to utilize the Website’s services. The User shall not breach the following terms and conditions while using the Website and engaging in any form of communication on any of the forums inclusive of the products listed on the Website:

 

The User shall not post, publish, or transmit any messages that are inaccurate, misleading, defamatory, harmful, threatening, abusive, harassing, defamatory, invades another’s privacy, offensive, promotes racism, hatred, or harm against any individual or group, religion, or caste, infringes upon another’s rights, which includes any intellectual property rights or copyright or trademark, violates or encourages any conduct that would violate any applicable law or regulation, or would give increase to any civil liability.
 

The User is not allowed to upload, post, or otherwise make available any content that the User does not have the right to make available under any law, contractual, or other fiduciary relationships. 
 

Any content that infringes any party’s patent, trademark, trade secret, copyright, or other proprietary rights may not be uploaded, posted, or otherwise made available by the User. However, the User is permitted to submit excerpts of copyrighted content as long as they follow the Fair Use guidelines.
 

In order to advertise, solicit, or send spam, the User is not permitted to gather screen names and email addresses of users who have registered on the website.
 

The User is not permitted to send chain letters, junk mail, spam, unsolicited emails, or promotions or advertisements for products or services.
 

The User is not permitted to upload or distribute any files that are contaminated with viruses, corrupted, or other similar softwares or programmes that could harm the Website’s functionality or the computers of other people.
 

The User is not allowed to take any action that disrupts or interrupts access to the Website.
 

By hacking, password mining, or any other illegitimate methods, the User shall not attempt to gain unauthorized access to any portion or feature of the Website, any other systems or networks linked to the Website, or any of the services provided on or through the Website.
 

The User shall not violate any applicable laws or regulations in place inside or outside India. The usage and continued use of the Website is subject to, but not limited to, using the services for personal purposes.
 

The User shall not resell or make commercial use of the Services without the Website’s express written consent.
 

The User shall not breach these Terms of Usage, including, but not limited to, any Additional terms of the Website mentioned herein or elsewhere.
 

The User agrees not to reverse engineer, modify, duplicate, distribute, transmit, display, perform, reproduce, license, create derivative works from, transfer, or sell any information or software received from the Website.
 

By becoming a Registered member of the Website, the User agrees to the following situations, which are not exhaustive and may include services incidental to those indicated below: 
 

The user agrees to receive communication through the app/website through email/SMS or any other type of medium, including Whatsapp Business Messages, regarding the usage of the app/website.
 

The User agrees not to transmit any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material of any type or form via the Website.
 

The User agrees not to provide any material that encourages action that could result in a criminal offense, civil liability, or otherwise violates any relevant local, state, national, or international law or regulation. It is strictly prohibited to attempt to obtain unauthorized access to other computer systems.
 

The User shall not interfere with the use or enjoyment of the Website or Services by any other members.
 

The User is obligated to report any misuse or abuse of the Site. If you observe any abuse or misuse of the Site or anything that is in violation of this Agreement, you must immediately report it to the Website by writing to Customer Care. On receipt of such a complaint, the Website may examine it and, if required, terminate the membership of the Member responsible for such violation, abuse, or misuse without refunding the subscription fee.
 

Any false complaint made by a Member may result in a termination of members membership with no refund of the subscription fee.
 

The Website keeps up the right, for any reason, to withdraw its services from any customer who is deemed to be unreasonable or abusive during their conversation with the Service Provider, including the astrologer.
 

While the Website will take all reasonable steps to address any situation that violates the above obligations, if the situation is uncontrollable, the Website maintains the right to issue a written warning in the future. Such violations, if repeated by the User, will result in a total ban from transacting on the site by such users. If the User has any balance in their wallet, it will be returned, subject to any further charges that may be imposed for similar violation.

 

BANK ACCOUNT INFORMATION
The User is under the obligation to give his banking information as and when required. The User’s obligations in this purpose are as follows:

 

The User agrees that the debit/credit card information provided by user for use of the aforementioned Service(s) must be true and accurate, and that the User shall not use a debit/credit card that is not lawfully owned by user or whose use is not authorized by the lawful owner thereof. Furthermore, the User agrees and undertakes to submit true and authentic debit/credit card information.
 

The User may pay the required fees to the Website using a debit/credit card or via online banking account. The User warranties, agrees, and confirms that when he/she initiates a payment transaction and/or issues an online payment instruction and submits his/her card / bank details:
 

The User has complete and lawfully entitled to use such credit/debit card or bank account for such transactions;
 

The User is responsible for ensuring that the card/bank account information given by them is correct.
 

The User is responsible for ensuring that sufficient credit is available on the nominated card/bank account at the time of payment to allow payment of the dues payable or bill(s) selected by the User, inclusive of the applicable Fee.
 

The User also agrees that if any part of these Terms of Usage is found to be invalid or unenforceable under applicable law, which includes but is not limited to the warranty disclaimers and liability limitations set forth herein, the invalid or unenforceable provision will be considered superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms of Usage will remain in effect.

 

DISCLAIMER / LIMITATION OF LIABILITY / WARRANTY
The User expressly understands and agrees that, to the greatest extent permissible by the applicable laws, the Website does not provide service warranties. Astrological counseling offered on the Website is based on astrologers’ cumulative or individual knowledge, experience, and interpretations, and as a result, it may differ from one astrologer to the another.

 

The Website provides services by a diverse panel of Astrologers who have been duly verified by the Website, and such Service Provider (Astrologer) may from time to time recommend the use of mantras, jantras, gemstones, or other astrological remedies to be employed by User. The astrologers are providing these recommendations in good faith; nonetheless, neither the Website nor any of its subsidiaries, affiliates, officers, employees, agents, partners, or licensors warrant that:
 

The service will satisfy your requirements.
 

The service will be available without interruption, on time, securely, and without error.
 

The service’s outcomes will be accurate or reliable.
 

The quality of any products, services, information, or other material purchased or received by you through the service will match your expectations.
 

Any software errors will be fixed. In order for the panel of astrologers on the website to make an informed decision about providing advice, you are needed to provide complete disclosure about the emotional, mental, and physical status of the person seeking advice.
 

The Website, its services, as well as other materials are provided “as is” without any warranty of any kind, express, implied, statutory, or otherwise, include implied warranties of title, non-infringement, merchantability, or fitness for a particular purpose. Mauhurtika charges per minute for the chat/call service provided on this platform and accepts no responsibility or liability for the actuality or reliability of the astrological effects on human physiology caused by the gems, or any other products or services claimed and sold on the website. You are not entitled to any warranty based on any advice or information obtained, whether oral or written.
 

The advisors, consultants, and astrologers are site members as well, not employees of the website or the company. However, the website verifies the degrees, credentials, background, and credentials of the advisors, consultants, and astrologers but does not refer to, endorse, recommend, verify, evaluate, or guarantee any advice, information, or other services offered by the company or the advisors, consultants, or astrologers, nor does it guarantee the validity, accuracy, completeness, safety, legality, quality, or applicability of the content, anything said or written by, or any advice provided.

PROPRIETARY RIGHTS TO CONTENT
The User understands that the Content is protected by copyrights, trademarks, service marks, patents, and/or other proprietary rights and laws, which include but not limited to text, software, music, sound, photographs, video, graphics, or other material that is contained in sponsor advertisements or distributed via email, that is commercially generated information provided to Member by the Website, its suppliers, and/or advertisers. Unless expressly authorized by the Website, its suppliers, or advertisers, the User is not allowed to copy, use, reproduce, distribute, perform, display, or make derivative works from the Content. Furthermore, the information on all of the Website’s portals, such as images, text, and designs, is sourced from numerous online portals, like Google images. Mauhurtika or Medhaavi Innovation Pvt Ltd. is not responsible for the content or data’s copyrights.

 

INDEMNIFICATION

Hate Speech
We do not permit users who incite violence or hatred against individuals or groups based on their race or ethnic origin, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, caste, immigration status, or any other characteristic associated with systemic discrimination or marginalization.Here are some examples of common violations:

Terrorist Content

 

The publication of content by terrorist organizations for any reason, including recruitment, is not permitted. 

 

Users that post content that supports terrorism, incites violence, or celebrates terrorist incidents are not permitted.

 

Dangerous Organizations and Movements

 

We forbid the publication of content for any objective, including recruiting, by movements or organizations that have participated in, planned, or claimed responsibility for acts of violence against civilians.

 

Users whose content involves preparation for or glorifying violence against civilians are not permitted.

 

Sensitive Events

 

We disallow the posting of content that capitalize on or are insensitive towards a sensitive occurrence that has had a substantial influence on society, culture, or politics, such as a civil emergency, a natural disaster, a public health emergency, a conflict, a death, or another tragic event. We firmly restrict our users from engaging in any sort of black magic, witchcraft, voodoo, or tantrism. If it comes to our attention that a user has engaged in any such activity, whether intentionally or intentionally or unknowingly, we reserve the right to delete the account.

GOVERNING LAW AND JURISDICTION
Any dispute, claim, or controversy coming out of or relating to these Terms of Usage, which includes the determination of the scope or applicability of these Terms of Usage to arbitrate, or your use of the Application or the information to which it provides access, shall be determined by arbitration in India, prior a sole arbitrator mutually appointed by Members and the Website. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act of 1996. The arbitration shall be held in [New Delhi]. All proceedings of such arbitration, which includes any awards, must be conducted in English. The award shall be final and binding on the disputing parties. 
 

Regardless of the foregoing, either party may seek interim or preliminary relief from a court of competent jurisdiction in [New Delhi] to protect such party’s rights pending the completion of any arbitration hereunder, and both parties agree to give to the exclusive jurisdiction of the courts of India and venue in [New Delhi] for any such proceeding. These Terms of Service and your use of the Services will be interpreted in accordance with Indian law, excluding its conflict of laws rules. The parties agree to submit any dispute coming under these Terms of Usage to the jurisdiction of a court in New Delhi for any actions in which the parties keep the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
